Spousal Consent for an IRA Beneficiary designation

I have a client that wants to change the primary beneficiary on her IRA to her Trust. The funds were from a 401k rollover. I know that in a community property state this requires spousal consent if the spouse is not the primary beneficiary. She lives in Oregon and the benficiary form states that both a community property state and a marital property state requires the spouse to consents to this action. The spouse is the income beneficiary of the revocable trust, but only one of two daughters is the ultimate benefciary. My question is does anyone know if Oregon is subject to either of these qualifications?



Oregon is not either of… the states are Alaska- if elected-, Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, and Wisconsin
