I have read somewhere that Congress has not extended the 2010 extention of ESA withdrawals for high school. Does anyone know where/when legislation is now and if there is a good possibility they will keep this as a viable savings vehicle for private high school?

See att’d link. Emphasis will certainly be focused on the 2009 expiring provisions, but sometimes a later year exiring provision may also be extended:
