Deceased IRA & RMD

Husband, 74 years old; taking RMD’s from his IRA. He passes away in 2009. His wife wants to take his IRA as her own in January 2010. Does a distribution from the deceased’s IRA have to be taken before the wife can transfer husband’s IRA to her IRA?



Since the wife did not assume ownership in the year of husband’s death (2009), she is deemed to be the owner for the entire year of 2010. Therefore, there is no RMD required before transfer even if she is also subject to RMDs.

And if she IS subject to RMDs in 2010 the 12/31/09 balance for the account must be added to her other IRAs to determine her RMD for 2010. which can be satisfied from any of her IRAs.
