Collecting Social Security with QDRO Pension

Hi all,

This is my first post here, but I was wondering if anyone might be able to answer a question I have:

I am 68 and planning to retire at the end of the year with Social Security. I was divorced in 2008 and receive 50% of a Public Retirement earned by my ex wife, who was a teacher. I think this technically counts as a pension because I am receiving it from the Washoe County School District in Nevada. In the divorce, the judge’s final decree included a QDRO making this a division of assets the same as all other joint assets. I have no other pension or benefits from my own work for any non Social Security governmental agency. I am wondering if my Social Security benefits will be reduced due to me collecting half of my ex-wife’s pension (in other words, does this count as my own pension for the purposes of collecting Social Security) under the WEP and GPO provisions of Social Security, which reduce the amount of your SS benefit if you are already receiving a government pension.

I feel like my benefits will most likely be reduced under these provisions but I am not sure. Does anyone out there know if this is the case?

See the second article in this blog, and the example, which is very similar to your situation. It suggests that your own SS benefits will NOT be reduced as a result of your QDRO settlement:

Thanks for the info. I’ve checked around an several sources (I was on hold with SSA for half an hour 😡 ) have told me the same thing, that my benefits will not be affected by my QDRO. Thanks a lot
