Spousal Beneficiary

Husband passed away in February of this year and before he had taken his RMD for this year. Surviving spouse took over the IRA (filed claim form and put IRA in her name) before RMD distribution was done for husband. Can surviving spouse take out distribution now to cover husbands RMD or is she stuck paying the 50% penalty on the RMD that should have come out before the account was put into her name? The surviving spouse was told by advisor that her husbands RMD would come out first before being put into her name and that was not done.

It is not a problem and there is no penalty. She DOES need to complete her husband’s RMD by 12/31 of this year however.
