Disclaiming Effects on GST

Can you give me an understanding of how disclaiming an Inherited IRA by the child of the IRA owner, allowing the Inherited IRA to go to the grandchild of the IRA owner by way of per stirpes is effected by GST, or counts against GST? Is there a good source that speaks to this topic? thanks, M

  • Yes, if the IRA goes to the grandchildren, it would count toward the $5,340,000 GST exemption.
  • If your estate is over $5,340,000, you should consult with competent counsel.
