Hello,
Parents have 2 children (3 grandchildren from these 2). They have 1 daughter-in-law (3rd child had passed away). Daughter-in-law has 1 child with parents’ son (who passed away a # of years ago) and 1 child with a new husband. Parents are close with everyone and, as contingent beneficiaries, want the 2 children (33 1/3% each), 1 grandchild and 1 daughter-in-law (each 16 2/3) to each be contingent beneficiaries per stirpes. If the grandson were to pass away, would his interest go to his mother (the daughter-in-law)? If the daughter-in-law were to pass away, would her interest go 1/2 to the grandchild and 1/2 to the other child of the daughter-in-law?
