Great post by the way, but a question.

Since a Solo 401k plan would not fall under ERISA, what is the asset protection of a Solo 401K within the non-ERISA plan (still a valid 401k…just not ERISA as one participant)?

The solo K (not covered under ERISA)  is still protected in bankruptcy under the federal bankruptcy Act, but outside of bankruptcy any protection falls under the state statutes. See this article:  http://www.irafinancialgroup.com/solo401kassetprotection.php
