TRANSFER VS ROLLOVER

1)Can a 457 PLAN (DEFERRED COMP PLAN) be transferred to a IRA?

2) If the transfer is a TRUSTEE-TO-TRUSTEE, does the “one-rollover-per-year limitation” apply?

3) Does the “one-rollover-per-year limitation” apply to a QDRO (QUALIFIED DOMESTIC RELATIONS ORDER) if the transfer is a TRUSTEE-TO-TRUSTEE?

  1. Yes, if the 457 is a govt 457b. Funds can be either rolled over indirectly or better yet, by direct rollover.
  2. The one rollover limitation only applies to IRA to IRA rollovers, so is inapplicable here.
  3. As above. If an IRA is awarded to an alternate payee (receiving spouse), it must be done by direct transfer, and the one rollover limit does not apply to IRA transfers.
