Should a Trust be Named as Beneficiary?

John and Jane have a son with limited mental capacity. They have a testamentary trust to provide for him after their deaths. Assuming the trust qualifies as a see-through trust, should we specifically name the trust as the contingent beneficiary?

Yes, to the extent they want to provide for him.  See my article on this subject in the March 2004 issue of BNA Tax Management’s Estates, Gifts & Trusts Journal:  http://www.elderlawanswers.com/Documents/Trusts%20as%20Beneficiaries%20of%20Retirement%20Benefits.pdf.

Is there another way to see the article you cited?  The web page says that it has been moved.
