I have a client where the husband is 75 and the spouse is under age 70. He is still working and has earned income and his wife is not working.

My question is “can the wife contribute to an IRA based on the earned income of the husband”, even though he is over age 70.5?



Yes, a spousal IRA contribution  in this situation is based on the age of the spouse whose IRA is receiving the contribution, not the age of the spouse with the earned income.
