Inherited IRA titled in name of trust.
My husband and I were both grantors and trustees of our trust. My husband recently passed at 71 and had not been taking RMDs yet. I would like to take RMD using my life expectancy when I turn 73. I am 66. The IRA custodian (& my CPA) said that I might need to take distributions next year over 10 years or even over 5 years. Then the IRA custodian said that I might need to establish a new trust for just his assets. My trust states I am the sole trustee now and the trust is revocable by me. A section in the trust states that “Upon a trustmaker’s death, our trust will become irrevocable as it pertains to the administration and distribution of the deceased Trustmaker’s trust property.” There are no other beneficiaries of the trust. The deceased Trustmaker’s property go to the surviving trustmaker.
Do I have a see-through trust that enables me to move my husband’s traditional IRA into my IRA or establish a new IRA in my name? Am I an edb? Can I take RMDs based on my life expectancy, put the IRA into my name without the trust name?
