Death Scenario

I had a question that I wanted to run by the room. I have a simultaneous death scenario question for you. Husband has an IRA. Wife is 100% primary, no contingents. If husband and wife pass away at the same time, the husband’s estate is bene, right? 



Probably, but it depends on state laws, particularly with respect to whether it has adopted the Uniform Simultaneous Death Act (about 21 states), and or if his will contains specific provisions that can modify the Act. If the IRA becomes subject to probate, sometimes both probates can be unified to speed up the process.
