Non-spouse inherits IRA and IRA owner not 73

I have a client who passed away 2/2025 at the age of 61 with his son as the sole beneficiary.  The son will need to follow the 10yr rule but does he have to take annual RMDs years 1-9?

I have a note from 2022 that the non-spouse wouldn’t have to take RMDs for the years 1-9 but would have to empty the IRA in year 10.



Client passed prior to RBD, therefore the son does not have annual RMDs, just needs to drain the inherited IRA by the end of 2035. That said, the son may wish to take voluntary distributions each year to spread the taxes and avoid a large taxable distribution at the end of the 10 year period.
