EDB on Inherited IRA – 33 year old Twins
Client inherited a T-IRA from his twin brother who died in 2022 when both were age 33. Would the surviving brother benficiary be an EDB b/c not more than 10 years younger than his twin? If so he gets stretch? If not, still would assume no RMDs now b/c brother was well under RBD when he passed away?

Yes, the beneficiary is an EDB and can stretch over his single life expectancy. If the 2023 and 2024 RMDs were not taken, they can be made up and a 5329 filed to request waiver of the penalty.
Beneficiary had an option to elect out of EDB treatment and into the 10 year rule, but the deadline for making that election would have been 12/31/2023. As such, the 10 year rule is no longer an option.

So to confirm, he still has to take RMDs, even though brother died before his RBD, albeit for the rest of his lifetime instead of 10 years. And if he dies prematurely and this goes to his spouse, she’d have the 10 year rule.

Yes, annual beneficiary RMDs are required of EDBs regardless of when the owner passed. When beneficiary passes, these beneficiary RMDs must continue for his spouse and the 10 year rule would also apply. His spouse cannot do the spousal rollover because she will be a successor beneficiary.
