IRA rollover for spouse beneficiary

IRA owner takes a distribution and then dies within the 60 day period. Can a spouse beneficiary rollover to her own IRA within the 60 days?

There have been several PLRs that allowed the spouse (assuming the spouse is sole beneficiary) to do a 60 day rollover, but since this is not in the tax code some custodians may balk at the request.  Securing a new PLR now would be cost prohibitive unless the amount of the distribution was substantial.

  • I obtained one such ruling, PLR 201514020:  https://www.irs.gov/pub/irs-wd/201514020.pdf .
  • I discuss several such rulings in my article in the June 2015 issue of Trusts & Estates:  https://www.kkwc.com/wp-content/uploads/2015/08/IRA-Rollovers-Making-this-option-possible.pdf .
