penalty free contribution distributions from ROTH IRA after Roth 401k R/O
50 yr old client opened her first Roth IRA July 2019 to receive Roth 401k rollover into then also added small contribution to same Roth. She now needs to access her “contributions” without penalty to resolve a cost overrun in this crazy building market. Is there a 5yr timeline to access ANY but specifically the 401k portion of her 3 yr old Roth IRA penalty free?

Her Roth IRA regular contribution basis includes the portion of the Roth 401k rollover attributed to her Roth 401k contributions in addition to the regular Roth IRA contributions she added. These amounts can be distributed tax and penalty free anytime and come out of her Roth IRA prior to any conversions or earnings. Her Roth 401k contributions will show in Box 5 of the 2019 1099R she received reporting the direct rollover. If she did any in plan Roth rollovers in the 401k or Roth conversions to her Roth IRA, please advise.
