Are the post 2020 Inherited ROTH IRAs subject to RMDs or does it also default to new 10 year rule?



A 10 year rule beneficiary of a Roth IRA is not subject to annual RMDs, just the 10 year rule. However, an EDB not subject to the 10 year rule is subject to annual RMDs with some special exemptions for sole spousal beneficiaries who continue as beneficiaries.



Are you referring to trust or charities?



No, just individuals. All Roth owners are treated as passing prior to RBD because there is no RBD for a Roth IRA. As such any 10 year rule beneficiary does not have to take annual RMDs as proposed in the IRS Secure Act Regs. But if the beneficiary is not subject to the 10 year rule because they are an EDB, they will have to take annual RMDs.  Who is the beneficiary you have in mind here?  Are they an EDB?
