inherited IRS’s(traditional)
2 questions:
1-If a spouse inherits a 401k and wants to roll it over into an IRA for themself…does it have to be registered as an inherited IRA…They are both under 7- 1/2 years old?
2-When a spouse inherits her spouses IRA and the dead spouse has started with RMD’s does the IRA have to be set up as a separate inherited IRA

Spouse can roll it to her own IRA. Unless she is under 59 1/2, this would probably be the best option, unless there is low-basis stock in the 401(k), in which case she should explore the NUA option. I thought I’d throw in the NUA comment before Alan does.
