higher education from an IRA
I know you can use an IRA for qualified higher ed expenses without the 10% penalty, but is the same true for pension plans, 401k’s ect?
Ex: if a client takes out $10,000 from his 401k or pension plan to pay for higher ed qualified expenses, will he be hit with the 10% penalty since its not a traditional IRA?

No, the higher education exception ONLY applies to IRA distributions, not to employer plan distributions.
