spouse is divorced but still shows as bene -options?
acct holder has a 401(k) but he is now deceased. he was divorced prior to death but his spouse still showing the beneficary. Does spouse who is still the beneficiary was was divorced prior to her husband’s death treat the assets as her own as if they were not divorced since beneficary information was never updated. Please reply

No. Since the marriage was dissolved prior to death, the former spouse is considered a non spouse beneficiary, and cannot roll over the funds. If decedent remarried, the former spouse may not even be considered a current beneficiary. If not re married, former spouse is treated as a non spouse beneficiary.
