We would like to change a SIMPLE plan from being tied to a single insurance company to being open for use with multiple providers by executing a 5304. What are the applicable timelines, deadlines, etc.? I know if you are establishing a new plan you have to have it in place by October 1, 2010 for the 2010 plan year. I also know that a new plan needs to be communicated to the employees 60 days prior to effective date. However, if you are changing from a 5305 to a 5304, what are the applicable deadlines, etc.? This isn’t really a new plan, so I’m not sure what traps to avoid….
