Keogh Plan Docs Not Updated

Taxpayer has a Keogh plan that was established in ’97. Wants to make a 2009 contribution by Oct. 15th. Trustee tells him that plan docs have not been updated since inception. Specifically, changes in 2003 and 2005. Wants to make the plan changes now for compliance and deduct the contribution on
the 2009 tax return? Any problems?
