72t Exception

If a client is collecting social security disaility, does that satisfy the disability requirement for the exception re: 72t?

  • It will in most cases, but there may be some small differences in the way SS determines benefits. Here is the technical definition with respect to 72t plans:   http://www.72t.net/72t/FAQ#Faq21
  • It is a good idea to get an MD letter confirming disability under 72m provisions
