QDROs only apply to qualified retirement plans, not to IRAs. Transfer of TIRA and Roth IRA accounts is less formal and only requires conditions to be included in the separate maintenance or divorce decrees. The appropriate IRA accounts then transfer to the receiving spouse under a “transfer incident to divorse”. Note that unlike a QDRO, distributions made to the receiving spouse are not exempt from the 10% early distribution penalty.
