Common law, spousal rollover from qualified plan
Can somebody provide info on how best to treat the following situation?
Here are the facts:
Decedent was a participant in a qualified retirement plan for his company
He was in his 50s when he died and his common-law spouse is in her 40s
Commonlaw spouse receives rollover from decedent’s qualified retirement plan
Distribution check is made payable to her estate attorney (mistakenly)
Because her attorney is attorney-in-fact, can he endorse the check over to an IRA for her and treat the distribution as a qualified rollover to a spousal beneficiary?
