Can an executor disclaim assets?
Can an executor disclaim an IRA inheritance for a deceased beneficiary. The beneciary died after the account owner. We are within 9 months of the date of death.
Thanks,
Chris

In some states, such as New York, an executor needs court approval to disclaim on behalf of a decedent. If the executor needs court approval to disclaim, he/she should allow sufficient time to obtain court approval. I’ve obtained court approval for a disclaimer by an executor.Bruce Steiner, attorney, NYC, also admitted in NJ and FL
