Form 5329 Filing for an Estate Fiscal Year
An Estate with fiscal year-end 6/30/17 missed the RMD for calendar 2016. Can we file the 2016 form 5329 now or do we have to wait until we file the fiscal 2016 form 1041? If we can file form 5329 now, where do we mail it?

The 5329 is rarely filed before the return covering the year end. Unless the 1041 will not be filed by 10/15 it would probably be better to file the 5329 with the 1041. If you are thinking that the penalty waiver chances are diminished if the IRS notifies the estate of the late RMD before the 5329 is filed I don’t think there is much chance of that, but the late RMD should be distributed ASAP.
