LIfe Insurance Tranfer of Value Question:

Husband owned life insurance on wife. (Wife is insured) Husband dies, wife can own her own life policy. But is there a transfer of value? So the cash value has to run through “His Estate” and be probated?



  • It’s not a transfer for value.
  • You probate the Will, not the assets.  The policy is an asset of his estate like any other asset, and it will pass in accordance with the terms of his Will.
