Capital Gain Distribution From Complex Trust To Beneficiary

Granted this question does not fall within the scope of an IRA so I apologize upfront. I know this forum has some very smart minds that be be able to answer my question.

If a complex irrevocable trust were to make a long term capital gain distribution to the beneficiary of the trust, how would the
distribution be taxed? Would the beneficiary’s distribution be taxed as long term capital gains?

  • Distributions generally carry out ordinary income but don’t carry out capital gains.  However, there are some exceptions.  The trustee should consult with competent tax/estates counsel.
