Spousal IRA Rights

Does a spouse have any rights to any portion of the other spouses IRA if the IRA with beneficiaries was established well prior to the marriage?

Perhaps in community property states. After marriage, no new contributions should be made to the pre marriage IRA as such contributions would be considered community property. It is possible for a court to declare how much of an IRA balance is separate property and how much is community property and that is a highly subjective process. I suggest keeping a copy of the last IRA statement prior to marriage, and not making any new contributions to account with a non spouse beneficiary.
