Ongoing Civil Case and Taxes

Although this is not specifically related to an IRA hopefully someone has some insight for me,

I have an ongoing civil case with my employer involving ADA, discrimination as well as wrongful termination. I have been paying my attorney throughout the last year, I am curious if I can write these expenses off on my 2020 taxes. Alternatively, do I need to wait until the case is settled and write these expenses off on the following year?
