Yes, it is still available with the rules unchanged for decades. There was some talk of eliminating it about 7 years ago, but no Congressional action was taken. If cap gains rates are increased for very high incomes, those who may well have many such appreciated employer shares still in their plans, there could be rush to distribute those shares and sell them before the cap gains rate increase.
