401k to HSA via Rule of 55?

I understand I can do a one time rollover from my IRA to my HSA. Do I have to be 59 1/2 to do this? If so, can I use the rule of 55 to roll over from my 401k to my HSA?



You should almost never even do an HSA Funding distribution unless you have no other penalty-free sources to fund the HSA.
You must be an HSA eligible individual to make what is essentially an HSA contribution.
You can only rollover from the IRA to the HSA up to your eligible contribution limit.
The amount of the rollover is subject to a testing period from the date of distribution until the last day of the 12th month after the distribution. You must remain an HSA eligible individual for the entire period. If you fail to do so, the entire distribution is subject ot ordinary income tax and the 10% early withdrawl penalty if < age 59 1/2.
Not only do you not have to be 59 1/2, you should never do an HSA funding distribution if >= age 59 1/2. You can simply make a taxable IRA withdrawal and a tax deductible HSA contribution without being subject to the 12 month testing period.
The so called Rule of 55 is a misnomer. It is simply an exception to the 10% early withdrawal penalty if you separated from that 401k plan in a year you were >= age 55.
While you can not do an HSA funding distribution in this case. You could simply take a distribution and make a tax deductible HSA contribution. However, be aware that even if eligible the 401k plan can and many do have distribution limitations. Many 401k plans do not have full discretionary post-separartion withdrawals.
Just because you can do something does not mean you should do something. When you do an HSA funding distribution or a taxable retirement plan distribution followed by a pre-tax or deductible HSA contribution. You are giving up the ability to reduce your AGI and various critical MAGIs with a pre-tax or deductible HSA contribution. Especially if you can make HSA contributions by salary reduction which are not only income tax free, but also FICA tax free.
