Successor Beneficiary to non EDB original Bene Pre Secure Act
Client inherited from post RBD mom who passed in 2018 and received IRA as non-spousal Bene and was taking RMDs based upon his Life Expectancy. He has now passed at 72 and asset moves to his 66yr old spouse. Does she keep his original RMD schedule? Can she choose to refigure Secure Act Divisors back to his original year after mom’s death then -1/yr for smaller RMD percentages? or does she fall under new 10 year RMD rules with Secure Act?

Yes, she continues his RMD schedule (reset to the new tables), but the 10 year rule also applies. Therefore, she must take annual RMDs and still drain the inherited IRA by 12/31/2032. If Mom had passed prior to her RBD, then she would not have to continue spouse’s RMDs, but would still have to drain the inherited IRA by 12/31/2032.
