IRA Beneficiary is older brother

An IRA owner died in 2022 at age 67.

The only beneficiary is the IRA owner’s 76 year old brother.
The beneficiary was 76 in 2022.

What Life Expectancy does the beneficiary use?
Is the beneficiary subject to the 10 year rule?

  • The beneficiary is an EDB (not more than 10 years younger than decedent) and therefore the 10 year rule does not apply UNLESS the beneficiary prefers the 10 year rule, and in that case could opt out of EDB treatment and into the 10 year rule by notifying the custodian by the end of 2023.
  • For life expectancy RMDs, the older brother would use his age in 2023 (77) and the single life table divisor. That divisor is reduced by 1.0 for each year after 2023. The older brother cannot use the age of the younger decedent for RMDs when they passed prior to RBD.
