The wife dies in 2023 before taking an RMD; the surviving spouse, age 80, is the primary beneficiary. Must the Surviving spouse take the RMD in 2023 or can he wait until 2024?

The proposed Secure Act Regs allow the year of death RMD to be distributed as late as the due date for the death year return including extensions. However, since the year of death is the final year to use joint tax rates, it might be best to complete this RMD in 2023. The surviving spouse will have a 2024 beneficiary RMD or an RMD as the owner due on the inherited balance, so adding the 2023 RMD to that total while filing single could be costly.
