Subtrusts – final regs
Per your 10/2024 Ed Slott IRA Advisor, Natalie Choate said that the Trust has to specify each beneficiary’s allocation of the IRA’s value among the subtrusts. She gave an example; “Any IRA payable to this trust on my death shall be allocated equally to the separate trusts established for my spouse and children.” If a trust says that al assets will be split equally among the beneficiaries, is that sufficient or does the trust have to specify that the IRA is split equally?

I am not an estate attorney like Natalie, but because an IRA is an asset, I think that the current wording is sufficient.
