When one spouse dies, can the other spouse gift the remaining unused portion for the deceased spouse? I know the one spouse can choose portability and use the deceased spouse’s amount for exclusion for estate purposes, but I’m really wanting to know if the remaining spouse can “gift” during her lifetime for example $10.9 million (if no gifting has been done yet for both spouses).
